Sponsor, agents and representatives of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (1) late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible or unsuccessful efforts to notify or contact winner notices; (2) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (3) failed, incomplete, garbled, or delayed computer transmissions; (4) any condition caused by events beyond the control of the Sponsor that may cause the Giveaway to be disrupted or corrupted; (5) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Giveaway or arising from the participant's access to and use of the Internet site http://www.kyharnessracing.com to the extent permitted by law including direct, indirect, incidental or consequential damages; or (6) any printing or typographical errors in any materials associated with the Giveaway. Sponsor reserves the right, in its sole discretion, to suspend or cancel Giveaway at any time if a computer virus, bug, worms, tampering, unauthorized intervention, fraud or other technical problem corrupts the administration, security, or proper play of the Giveaway.
